AgentGate terms of use

These terms govern your use of AgentGate ("the app"), provided by Elektraset, s.r.o. ("we", "us"). Website: https://elektraset.com/. Contact: help@elektraset.com.
If you get the app through the Atlassian Marketplace, the Atlassian Marketplace Terms of Use also apply between you and Atlassian. If these terms conflict with the Marketplace terms that apply to us as a vendor, the Marketplace terms win.
1. The service
AgentGate is a gateway between AI clients and your Jira Cloud and Confluence Cloud site. It enforces the clients, credentials, policies, budgets, dry-run and approval rules that your administrators configure, and records audit events. The gateway service runs at https://agentgate-ai-governance.apps.elektraset.com.
2. Your responsibilities
- You configure the policies. AgentGate enforces what you configure; it does not decide what your agents should be allowed to do.
- AgentGate only governs traffic that is routed through it. Direct connections (for example personal API tokens or other MCP servers) must be restricted with your Atlassian organization settings.
- Keep gateway credentials secret and revoke them when they may have leaked.
- Use the app in line with the law, the Atlassian terms and the terms of your AI vendors. Do not use it to attack, overload or probe the service.
3. Licence
While your subscription or evaluation is active, we grant you a non-exclusive, non-transferable right to use the app for your organization's sites where it is installed. You may not resell, reverse engineer (except where the law allows it) or remove notices from the app.
4. Fees
Fees, if any, are charged by Atlassian through the Marketplace according to the listing. Evaluation periods are free.
5. Your data
You keep all rights to your data. We process it only to provide the app, as described in the privacy policy, and act as your processor for site content.
6. Availability and changes
We aim for high availability but do not guarantee uninterrupted service. If the gateway is unavailable, calls through it fail closed: agents get no access instead of unchecked access. We may change the app; we announce changes that remove features at least 30 days in advance where possible.
7. Warranty
The app is provided "as is" to the extent the law allows. We do not warrant that the app prevents every misuse of AI clients or that it is error-free.
8. Liability
To the extent the law allows, our total liability for all claims in a 12-month period is limited to the fees you paid for the app in that period. We are not liable for indirect or consequential damages, lost profits or lost data. Nothing limits liability that cannot be limited by law (for example for intent or gross negligence).
9. Termination
You can stop using the app at any time by uninstalling it. We may suspend access if you breach these terms or if needed to protect the service. After termination, data is deleted as described in the privacy policy.
10. Law
These terms are governed by the laws of the Czech Republic. The courts of the Czech Republic have jurisdiction, unless mandatory consumer law says otherwise.
